These Terms and Conditions set out the rules for using cergemedia.com (the “website”) and the terms on which we sell products through the Cerge Media shop (the “shop”). Please read them carefully. By using the website you agree to the website terms below. If you place an order, the shop terms also apply to your purchase.
If you don’t agree with these terms, please don’t use the website or buy from the shop.
The website and shop are operated by Cerge Media, an independent online magazine based in London, United Kingdom (“we”, “us”, “our”). You can contact us at [email protected].
These terms should be read together with our Privacy Policy, Cookie Policy, Disclaimer and Shipping & Returns page.
The website is free to read. We don’t guarantee that it, or any content on it, will always be available or uninterrupted. We may suspend or restrict the website for maintenance or security reasons. You are responsible for keeping any account details secure.
You may use the website only for lawful purposes. You must not:
Our security systems monitor and may block traffic that appears to be malicious. If you breach these terms, we may suspend or withdraw your access, remove content you have posted, and take any other action we consider appropriate, including legal action.
We own, or are licensed to use, all intellectual property rights in the website and its content, including articles, headlines, design, graphics, logos and the Cerge Media name. These are protected by copyright, trade mark and other laws in the UK and internationally.
You may view, print or download extracts from the website for your personal, non-commercial use, and you may share links to our articles. You may quote short extracts for the purposes of criticism, review or news reporting, as permitted by the Copyright, Designs and Patents Act 1988, provided you give proper acknowledgement and a link to the original article.
You must not republish whole articles or substantial parts of them, remove copyright notices, or use our content for commercial purposes without our written permission. Some images on the website are used under third-party licences (such as Creative Commons licences) and remain the property of their creators; your right to reuse them is governed by those licences, not by us.
If you believe content on our website infringes your rights, please see our Copyright & DMCA Policy.
Where we allow comments or other contributions, you are responsible for what you post. By posting content you confirm that:
You keep ownership of what you post, but you grant us a non-exclusive, royalty-free, worldwide licence to publish, display, edit for length or legal reasons, and remove it in connection with the website.
We may refuse, edit or remove any comment at our discretion. Views expressed in comments belong to their authors.
Our articles link to other websites for information only. We have no control over those sites and are not responsible for them. Some links may be affiliate links, as explained in our Disclaimer.
You may link to our home page or articles, provided you do so in a way that is fair and legal and does not damage our reputation or suggest any association, approval or endorsement on our part that does not exist. You must not frame our website on another site.
We work hard to make our journalism accurate and correct errors when we find them, but content on the website is for general information only and is not professional advice. Please see our Disclaimer.
You must be at least 18 years old, or have the permission of a parent or guardian, to place an order. These shop terms apply to consumers buying for personal use. If you are buying for a business, please contact us first, as some of the consumer rights described below do not apply to business purchases.
We sell Cerge Media branded stationery, desk accessories and similar merchandise. We describe and photograph our products as accurately as we can. Colours may look slightly different on your screen, and products made from natural materials such as bamboo or cotton can vary slightly from item to item. Product images may show a representative example of the type of item rather than the exact unit you receive. Dimensions and weights are approximate.
When you place an order, you will receive an email confirming that we have received it. This acknowledgement does not mean your order has been accepted. Our acceptance takes place when we email you to confirm that your order has been dispatched, at which point a contract is formed between you and us.
We may decline an order, for example if a product is out of stock, if we can’t verify payment, if there is an obvious pricing error, or if we can’t deliver to your address. If we decline your order after you have paid, we will refund you in full.
All prices are shown in pounds sterling (GBP) and include VAT where applicable. Delivery charges are shown separately at checkout before you pay.
We try to make sure all prices are correct, but errors can happen. If we find an error in the price of a product you have ordered, we will contact you to let you know and ask whether you want to continue at the correct price or cancel. If the correct price is lower, we will charge you the lower amount. If a pricing error is obvious and could reasonably have been recognised as a mistake, we are not obliged to supply the product at the incorrect price.
Payment is taken at the time you place your order. Payments are processed securely by third-party payment providers, and we do not store your full card details. The payment methods available are shown at checkout. If your payment is declined or cannot be verified, we won’t be able to process your order.
Orders to addresses outside the UK may be subject to import duties, taxes and customs charges in the destination country. These are the responsibility of the recipient and are not included in our prices.
We deliver to addresses in the United Kingdom as standard. Delivery costs and estimated delivery times are set out on our Shipping & Returns page and at checkout. At the time of writing, standard UK delivery costs £3.95 and usually takes 3–5 working days, and UK delivery is free on orders over £40.
International delivery is available on request. Please email us with your address and the items you’d like before ordering, and we will confirm whether we can deliver and what it will cost.
Delivery times are estimates. If we are delayed by events outside our reasonable control, such as postal strikes or severe weather, we will let you know. If there is a risk of substantial delay you may cancel and receive a refund for anything you have paid for and not received.
Unless we have agreed otherwise, we will deliver your order within 30 days of accepting it. Ownership of and responsibility for the products pass to you when they are delivered to the address you gave us.
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your order within 14 days without giving a reason.
The cancellation period ends 14 days after the day on which you, or someone you nominate, receive the goods. If your order is delivered in several parts, it ends 14 days after you receive the last item.
To cancel, tell us clearly before the cancellation period ends by emailing [email protected] with your name, order number and the items you wish to cancel. You can use the following wording if you like: “I hereby give notice that I cancel my contract for the sale of the following goods: [items], ordered on [date], received on [date].”
If you cancel, we will refund all payments received from you for the cancelled items, including the cost of standard delivery. If you chose a more expensive delivery method than our cheapest standard option, we will only refund the cost of the standard option.
We will make the refund without undue delay, and no later than 14 days after we receive the goods back, or after you provide evidence that you have sent them back, whichever is earlier. We will refund you using the same payment method you used, and you will not be charged any fees for the refund.
You must send the goods back to us without undue delay, and no later than 14 days after the day you tell us you are cancelling. You will need to pay the direct cost of returning the goods unless they are faulty or not as described.
You may examine the goods as you would in a shop, but if they have been handled or used beyond what is necessary to establish their nature, characteristics and functioning, we may reduce your refund to reflect any loss in value. For example, a notebook that has been written in, or a mug that has been used, cannot be returned under the cancellation right in full-value condition.
Details of how to return items, including where to send them, are on our Shipping & Returns page. Please email us before sending anything back so we can confirm the return address and look out for your parcel. We recommend using a tracked service, as returned items remain your responsibility until they reach us.
Under the Consumer Rights Act 2015, goods must be as described, fit for purpose and of satisfactory quality. If something you receive is faulty, damaged or not as described, your legal rights include:
If an item arrives faulty or damaged, please email us with your order number, a description of the problem and, if possible, a photo. We will arrange a replacement or refund and cover reasonable return postage costs. These rights are in addition to, and not affected by, your right to cancel under the cancellation section above.
Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot be excluded or limited under English law. Nothing in these terms affects your statutory rights as a consumer.
Subject to that, if we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of our breach or our failure to use reasonable care and skill. Loss or damage is foreseeable if it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
For shop orders, our total liability to you in connection with any order is limited to the price you paid for that order, except where the law does not permit such a limit.
In relation to the editorial content of the website, which is provided free of charge for general information, we are not liable for any loss or damage arising from your reliance on that content, to the fullest extent permitted by law. We supply the website for domestic and private use only and are not liable for any loss of profit, loss of business, business interruption or loss of business opportunity.
We may revise these terms from time to time. The version in force when you use the website, or when you place an order, applies to that use or order. Please check this page whenever you use the website or buy from the shop. The date at the top shows when these terms were last updated.
If a court finds any part of these terms invalid or unenforceable, the rest will continue to apply. If we delay enforcing these terms, we can still enforce them later. We may transfer our rights and obligations to another organisation and will tell you if we do; this will not affect your rights. No other person has any rights to enforce these terms.
If you have a complaint, please email us first at [email protected]. We aim to reply within 2–3 working days and will try to resolve things fairly and quickly.
These terms, and any dispute or claim arising out of or in connection with them or with your use of the website or purchases from the shop, are governed by the law of England and Wales. You and we both agree that the courts of England and Wales will have jurisdiction, except that if you live in Scotland you can also bring proceedings in Scotland, and if you live in Northern Ireland you can also bring proceedings in Northern Ireland.
